GILNEX ACCEPTABLE USE POLICY

This Acceptable Use Policy ("AUP") governs use of the GILNEX platform, websites, APIs, and related services (collectively, the "Platform"). It supplements the GILNEX Terms of Service. Capitalized terms not defined here have the meanings in the Terms.
1. PERMITTED USE
You may use the Platform only for lawful business purposes related to marketing, lead management, customer communication, and growth operations for a business you own or are authorized to represent.
2. PROHIBITED USES
You may not use the Platform to:
- Send unsolicited bulk messages (spam) or violate CAN-SPAM, TCPA, or applicable telemarketing laws
- Harass, threaten, defraud, or impersonate any person or entity
- Upload or transmit malware, phishing content, or unlawful material
- Scrape, reverse engineer, or attempt to bypass security or rate limits without written authorization
- Resell, sublicense, or white-label GILNEX services without a written agreement
- Misrepresent your business, licenses, pricing, or affiliations
- Process protected health information (PHI) without an executed Business Associate Agreement (BAA)
- Infringe intellectual property, privacy, or publicity rights of others
3. CLIENT CONTENT & COMPLIANCE
You are solely responsible for content you or your users submit through the Platform, including SMS templates, email campaigns, and chatbot responses. You must obtain all required consents before contacting individuals and honor opt-out requests promptly.
4. ENFORCEMENT & SUSPENSION
GILNEX may investigate suspected violations and, without limiting other remedies, suspend or terminate access, remove content, or report unlawful activity to authorities. We will provide notice when practicable, except where immediate action is required to protect users or comply with law.
5. DMCA / COPYRIGHT COMPLAINTS
If you believe content on the Platform infringes your copyright, send a notice to [email protected] including: (1) identification of the copyrighted work; (2) identification of the infringing material and its location; (3) your contact information; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that your notice is accurate; and (6) your physical or electronic signature.
6. ABUSE REPORTING
Report security incidents, abuse, or policy violations to [email protected]. For privacy-related requests, contact [email protected].
7. CHANGES
We may update this AUP. Material changes will be communicated per our Terms and applicable law, including California AB 2863 where auto-renewal disclosures apply.
